Scope of application

The purpose of this document is to regulate the general terms or conditions of procurement of the Pre-booking and Online Booking services of NextTo platform with registered in Sydney, Australia,

When you make your reservation, you will be also deemed to have read, understood and accepted the terms and conditions for using the NextTo website (which is www.NextToAu.com)and any relevant terms and conditions shall be deemed to be incorporated into your reservation and the accommodation agreement with NextTo. The link to the terms and conditions.

When you make your reservation, whether online or by telephone, you will be deemed to have read, understood and accepted these Reservation Terms and Conditions and the Reservation Privacy Policy. The use of these services implies full and unconditional acceptance and validity of each and all the General Terms and/or Conditions – which are deemed to be automatically incorporated into the contract concluded with NextTo, without the need for your written transcription in the same.

 

Definitions

In these terms and conditions:

“We”, “Our”, “Us” and “NextTo” means any property associated with, operated by, NextTo platform and owned properties.

The terms “You” and “User” are used here to refer to all individuals and/or entities who for whatever reason access www.next2au.com or use its services.

“Best Available Rate” means the best available rate on any given day for a particular Participating Property.

“Child” or “Children” has the meaning as outlined below

“Rate” “Standard Rate” “Best Available Rate” “Special Rate” “Package Rate” means the accommodation rate or package booked.

“Accommodation Voucher” means an accommodation voucher bearing NextTo Brand Logo with registered Voucher Number.

“Username” means if you are an Adara Advantage Member.

“Standard Booking” means a booking at any Participating Property other than an NextTo Advantage, Non-Refundable(commonly as special prize) or Peak Season Booking.

These Terms and Conditions shall apply to all contracts for the provision of NextTo Properties for accommodation and all related services,They shall apply exclusively.

How to book with us

Bookings can be made over the internet at www.next2au.com or at our various individual property websites, or by emailing [email protected] or by telephone at (02) 8074 2363

The NextTo website and telephone facility enables you to check the accommodation offerings and availability (and related products and services), and then submit an online or telephone reservation request via NextTo. On completion of the reservation process, the Reservations Facility will transmit an online or email confirmation of your reservation. A reservation is only valid when a reservation.

Policy to all members

By posting content on Nextto, you agree to abide by this policy. We reserve the right to remove any content, in whole or part, that violates this policyIn the event of repeated or severe violations, we may suspend or permanently deactivate the account(s) in question.

You can report the content directly or contact us([email protected]) to report content that appears to violate this policy.

The following content is never allowed on Nextto:

Content created solely for the purpose of advertising or other commercial content, including company logos, links, or company names

  • Spam, unwanted contact, or content that is shared repeatedly in a disruptive manner
  • Content that endorses or promotes illegal or harmful activity, or that is sexually explicit, violent, graphic, threatening, or harassing
  • Attempts to impersonate another person, account, or entity, including a representative of Nextto
  • Content that is illegal or that violates another person’s or entity’s rights, including intellectual property rights and privacy rights
  • Content that includes another person’s private or confidential information, including content that is sufficient to identify a listing’s location

The following are policy violations specific to a type of the content:

Listing titles

  • Listing titles that include information irrelevant to the listing type, style, or experience
  • Listing titles that include symbols or emojis

Listing or profile pages

  • Listings and profiles that provide fraudulent, false, misleading, or deceptive information

Reviews that are biased and exhibit indications of extortion/incentivisation, conflicts of interest, or direct competition

Reviews that contain no relevant information about a host or guest, listing, or experience, the review will be removed. Reviews that contain mostly irrelevant information are also subject to removal, but only where the otherwise relevant information would not be expected to meaningfully inform the booking decisions of other community members.

 

NextTo Review Policy

In order to build a platform of trust, we need to ensure that reviews on Nextto are useful, informative, and do not expose our community to harm. Therefore, Nextto expects that all reviews adhere to the following:

We aim to display search results that are relevant for you, by providing a personalised default ranking of Trip Providers on our Platform. You can scroll through this default ranking, use filters and sort by alternative ranking orders and thus have the ability to influence the presentation of search results to receive a ranking order based on other criteria. We use multiple algorithms to produce default ranking results, this process is constantly evolving.

Accommodation’s star rating displayed on NextTo is not determined by NextTo. The accommodation determines their star rating themselves or it is determined by an independent third party provider of (objective) star ratings. Deals are shown on the basis of the number of stars (low to high or high to low) that providers provide to NextTo. Depending on the (local) regulations, the star classifications either are assigned by an (independent) third party, for example an (official) hotel rating organisation or are based on the opinion of the accommodation providers themselves, irrespective of objective criteria. NextTo does not impose formal obligations on star ratings and does not review them. Overall, the star classification is a representation of how the accommodation compares to the legal requirements (if applicable) or, if not regulated, the sector or (customary) industry standards in terms of price, facilities and available services (these requirements and standards can vary between different countries and organisations).

In order to make it easier for customers to find the right match to their travel preferences, NextTo may assign a quality rating, In order to determine the comparable set, the quality rating is based on many (400+) features which can be divided over 4 major categories: (i) facilities/amenities/services offered by the accommodation on NextTo, (ii) property configuration such as unit size, number of rooms and occupancy, (iii) number and quality of the photos uploaded by the accommodation, (iv) anonymised and aggregated historical booking data (for example, to assess the star rating of booked accommodations). We use these multiple features to derive statistical patterns. Based on these inputs, a machine-learning based analysis is being conducted which results in a quality rating being automatically calculated and awarded to the accommodation.

Only customers who have stayed at the Accommodation will be invited by NextTo to comment on their stay at the relevant accommodations and to provide a score for certain aspects of their stay or may receive a rating request during their stay. The completed guest review (including submitted rating during your stay) may be (a) uploaded onto the relevant Trip Provider’s information page on our Platform for the sole purpose of informing (future) customers of your opinion of the service (level) and quality of the Trip Provider, and (b) (wholly or partly) used and placed by NextTo at its sole discretion (e.g. for marketing, promotion, or improvement of our service) on our Platform or such social media platforms, newsletters, special promotions, apps, or other channels owned, hosted, used, or controlled by NextTo and our business partners. In order to offer and maintain recent (and therefore relevant) reviews, reviews can only be submitted within a limited period of time (3 months) after a stay and each review will only be available for a limited period of time (up to 36 months) after posting. The default ranking of the reviews is by date of submission relative to a few additional criteria (such as language, reviews with comments), whereas a review of a customer who [always] submits comprehensive and detailed reviews (aka “Property Scout”) may be ranked on top. You have the option to choose various different forms of ranking and filter (e.g. by audience, date, language, score). NextTo does allow the Trip Provider to respond to a review. We reserve the right to adjust, refuse, or remove reviews at our sole discretion insofar it violates our review policy. NextTo does not compensate or otherwise reward a customer for completing a review. The guest review form should be regarded as a survey and does not include any (further commercial) offers, invitations, or incentives whatsoever. NextTo undertakes to use its best efforts to monitor and remove reviews that include obscenities or the mention of an individual’s name or reference to stolen goods.

NextTo will not accept reviews which include:

  • Profanity, sexually explicit, hate speech, discriminatory, threats, violence
  • Mention of full names, personal attack towards the staff
  • Promoting illegal activities (e.g. drugs, prostitution)
  • Sites, emails and addresses, phone numbers, cc details
  • Politically sensitive comments
  • NextTo and the Trip Provider are each entitled to terminate their relationship for whatever reason (including in the event of breach of contract or (filing for) bankruptcy) with due observance of the relevant notice period as agreed between both parties.
  • Reviews should not violate our content policy.
  • Some content is never allowed on Nextto..
  • Reviews should be unbiased.
  • Reviews are most helpful when they provide unbiased information. Therefore, we don’t allow individuals or entities who own or are affiliated with a listing or experience to post reviews of their business, nor do we allow individuals who are confirmed to offer competing listings or experiences to post reviews of their direct competitors.
  • You are not allowed to incentivise positive reviews, to use the threat of a negative review to manipulate a desired outcome, or to influence another’s review with the promise of compensation.
  • You are also not allowed to accept fake reservations in exchange for a positive review, use a second account to leave yourself a review, or coordinate with business partners to get positive reviews.
  • Reviews should be relevant.
  • Keep your reviews relevant to Nextto and your stay or experience. Other guests are reading your reviews to learn about the host and listing. Reviews that are off-topic are distracting and don’t help our guests make informed booking decisions. For this reason, reviews should focus on your interactions with other community members and your time during the stay or experience.
  • To keep reviews relevant, we recommend avoiding the following:
  • Commentary about a person’s social, political or religious views
  • Profanity, name calling, and assumptions about a person’s character or personality
  • Content that refers to circumstances entirely outside of another’s control
  • Content about services not related to Nextto (ex. an airline, ride-share, restaurant, etc)
  • Commentary about past Nextto reservations, or guests, or about the Nextto product where it does not relate to the listing, host or guest you are rating
  • When we receive a report of a review that violates this policy, we may remove the review from our platform. Repeated violations may lead to suspension or permanent deactivation of responsible account(s).

Reporting a review that violates this policy

  • To report a review for violating Nextto’s review policy, contact us. If you feel a review is untrue
  • While we encourage and expect all community members to post reviews that contain objective and accurate information, Nextto does not mediate disputes concerning truth or fairness. We expect the author of the review to stand behind the content of their review.

 

Reservation & Cancellation policy

Reservation

  • Please read carefully the booking rules below. Each booking, after its confirmation, has the value of acceptance of the contract according to current Australia legislation. The contract is binding for those making the booking and for all other persons mentioned in the same, minors included.
  • By using this Website to make reservations with NextTo, you agree to be bound by all of such NextTo’s standard terms and conditions and by any other policies, terms and conditions that may apply.  you hereby authorize the NextTo to use your personal information including credit/ debit card information that you provide to us for the purpose of the reservation. You may only make reservations through this Website for yourself and your guests. If you intend to book more than 5 rooms at the same NextTo for the same period of stay on behalf of one or more guests, you must contact the NextTo directly to make the reservation. You are prohibited from using this Website for the purposes of reselling, posting, advertising or marketing reservations (whether online or otherwise) to third parties including online agents, third-party owned websites, or travel agents.NextTo reserves the right to require proper proof of identity (e.g. passports or national identity cards) from all persons checking in. The NextTo has the absolute discretion to refuse to check in if the identity does not match with the person mentioned in your reservation or if anyone refuses to provide the requisite proof of identity to the NextTo. We reserve the right to cancel or modify at our sole discretion any reservations that have been made in breach of the Terms and Conditions or for false, fraudulent or unauthorized purposes.

 

Credit/ Debit Card Information

  • you must provide valid credit/ debit card information (such as card type, card number, expiry date and the full name shown on the card) to us and to the NextTo to secure your reservation or to pay an advance deposit for prepaid or advance purchases.
  • By providing your credit/ debit card information, you represent and warrant that
  • you are legally authorized to use the credit/ debit card you provided;
  • you authorize us to charge you in full for all charges incurred by you and your guests (if applicable) or charged to your account for all products and services purchased by you and any damage or loss caused by you and your guests during your stay (including, without limitation, damage to the NextTo’s property);
  • you authorize us to charge you in full the prepayment or advance purchase at the time of reservation; and
  • you authorize us to charge any cancellation charges to your credit/ debit card.
  • While all reasonable security measures will be taken to secure your credit/ debit card information, you agree to hold us and our employees and officers harmless and release us from any actions, claims, liability, damage or loss resulting from any loss, release, compromise, or disclosure of your credit/ debit card information caused by malware attacks, phishing attacks, viruses, hacking activities, malicious software and any other unlawful interference of the Website’s operating system or unauthorized access by third parties.

 

Deposit & Cancellation

  • At the time of booking, all reservations require a deposit to be taken to secure the booking. The amount will cover the whole period of accommodation + any special orders by a valid Visa + security deposit (refundable) , MasterCard or American Express credit card. The balance will then be withdrawn once a Reservation is made successfully by the nominated Credit Card.
  • The following charge will be applied in relation to each booking if u cancel your booking.
  • Up to 14 days prior to your scheduled check-in time and within 24 hours of your booking: full refund for cancellation fee will be applied and any deposit you have paid for your booking will be returned.
  • If the check-in date is at least 7 days away (to 14days) and within 24 hours of your booking: a 50% cancellation fee will be deducted.
  • Within 7 days of your scheduled check-in time or any cancellation over 24 hours of your booking: a 100% cancellation fee will apply and you will be required to pay to NextTo the full amount of your booking less any amount which you have already paid.
  • Any Bookings from our member, if you cancel your booking outside of 7 days or within 24 hours of your booking no fee will be charged.
  • For Non-refundable Bookings (Special price), if you cancel your booking at any time after it is made no refund of the funds paid for your booking will be made.
  • Any cancellation fees payable by you will be deducted from any monies paid by you to NextTo Platform and if insufficient funds are available we may charge, and you authorize our platform, the credit card the details of which you provided at the time of making your booking.
  • Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be held by NextTo platform as Booking Credit which can be applied to any future bookings you make with NextTo platform.
  • Any surcharge applied to credit cards at the time payment for the booking is made will not be refunded

 

Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the Trip Reservation confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Trip Provider as made available on our Platform, (iii) the services rendered or the products offered by the Trip Provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Trip Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives, subcontractors or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

NextTo is not responsible (and disclaims any liability) for the use, validity, quality, suitability, fitness and due disclosure of the Trip and makes no representations, warranties or conditions of any kind in this respect, whether implied, statutory or otherwise, including any implied warranties of merchantability, title, non-infringement or fitness for a particular purpose. You acknowledge and agree that the relevant Trip Provider is solely responsible and assumes all responsibility and liability in respect of the Trip (including any warranties and representations made by the Trip Provider). NextTo is not a (re)seller of the Trip. Complaints or claims in respect of the Trip (including related to the offered (special/promotion) price, policy or specific requests made by Customers) are to be dealt with by the Trip Provider. NextTo is not responsible for and disclaims any liability in respect of such complaints, claims and (product) liabilities.

Whether or not the Trip Provider has charged you for your Trip, or if we are facilitating the payment of the (Trip) price or fee, you agree and acknowledge that the Trip Provider is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the (Trip) price or fee to the relevant tax authorities. NextTo is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (Trip) price or fee to the relevant tax authorities. NextTo does not act as the merchant of record for any product or service made available on the Platform.

By uploading photos/images onto our system (for instance in addition to a review) you certify, warrant and agree that you own the copyright to the photos/images and that you agree that NextTo may use the uploaded photos/images on its (mobile) website and app, and in (online/offline) promotional materials and publications and as NextTo at its discretion sees fit. You are granting NextTo a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as NextTo at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, accommodation owners) due to NextTo publishing and using these photos/images. NextTo does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of NextTo. NextTo disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by NextTo at any time and without prior notice.
